Welcome to SkyBrawl, developed and operated by Agarthean Studios. By accessing or playing SkyBrawl (the "Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not play the Game.

These Terms apply to all players regardless of whether you sign in with a Google account or play as a Guest.

1. Eligibility

SkyBrawl is intended for players aged 13 and older. If you are under 13, you may not create an account or play the Game. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

3. Acceptable Use & Fair Play

To keep SkyBrawl fair and enjoyable for everyone, you agree not to:

• Use cheats, hacks, aimbots, or any software that gives you an unfair advantage.
• Exploit bugs or glitches to gain an in-game benefit. If you find a bug, please report it instead.
• Harass, threaten, or abuse other players through the lobby chat or any other means.
• Impersonate other players, Agarthean Studios staff, or any real person.
• Use the Game to transmit spam, malware, or any harmful content.
• Attempt to reverse-engineer, decompile, or modify the Game's code without written permission.
• Use automated scripts or bots to interact with the Game.

4. In-Game Chat

SkyBrawl includes a lobby chat feature. You are solely responsible for what you write. You agree not to use the chat to post content that is hateful, sexually explicit, threatening, or otherwise offensive. We reserve the right — but not the obligation — to monitor chat and remove content or ban players who violate this policy.

5. Premium Tier

SkyBrawl offers a free tier (supported by advertising) and a Premium tier (ad-free experience). Premium status is currently granted manually by Agarthean Studios. If a commercial purchase option is introduced in the future, additional terms regarding refunds and billing will be provided at that time.

Premium benefits (including ad suppression) are tied to your Google account and are non-transferable.

6. Intellectual Property

All content in SkyBrawl — including but not limited to the game name, logo, artwork, sound effects, music, code, and game mechanics — is the exclusive property of Agarthean Studios and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any part of the Game without our prior written consent. Streaming or creating content about SkyBrawl for non-commercial purposes (e.g., YouTube, Twitch) is permitted and encouraged.

7. User-Generated Content

Any content you submit through the Game — such as your chosen callsign — must not be offensive, infringing, or in violation of any third party's rights. By submitting content, you grant Agarthean Studios a worldwide, royalty-free licence to use, display, and moderate that content in connection with operating the Game.

8. Third-Party Services

SkyBrawl is built on Google Firebase (Authentication, Realtime Database, Firestore, Hosting) and uses Google AdSense for advertising on the free tier. Your use of these services is also governed by Google's Terms of Service.

9. Disclaimers & Limitation of Liability

SkyBrawl is provided "as is" and "as available", without warranty of any kind. We do not guarantee uninterrupted or error-free operation of the Game.

To the fullest extent permitted by applicable law, Agarthean Studios shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Game — including loss of in-game data, stats, or progress.

10. Availability & Modifications

We reserve the right to modify, suspend, or discontinue any part of the Game at any time, with or without notice. We may also update game mechanics, lobby rules, and features as part of ongoing development. Continued play after changes constitutes acceptance of those changes.

11. Termination

You may stop using the Game at any time. If you wish to have your account and data permanently deleted, contact us at the address below.

We may terminate your access to all or part of the Game at any time if you breach these Terms, or for any other reason at our sole discretion. Sections 6 (Intellectual Property), 9 (Disclaimers), and 12 (Governing Law) survive termination.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Agarthean Studios operates. Any disputes arising from these Terms or your use of the Game shall be resolved through good-faith negotiation before any formal proceedings.
